The Texas Two-Step

Back in 2005 Texans passed an amendment to their constitution intended to ban gay marriage, polygamous marriage, bestial marriage, and just about any other kind of marriage they could think of. And they did. They even banned heterosexual marriage. Up until recently, Texans living together in any intimate nature have been living in sin. They should be ashamed.

If it weren’t for a gay couple in Dallas, they may still be sinning today. They should be thankful that a gay couple would stand up for heterosexual rights. The amendment was supposedly struck down on the basis of violating the 14th amendment to the US Constitution. But there was no violation. All couples, not just gay couples, could not get legally married in Texas. Of course, since the other 49 states do allow some kind of marriage, then, at least for straights, the 14th amendment would apply. Once again, Texans should be grateful to this brave, altruistic, gay couple.

Prop 2 had two provisions. First, marriage in this state (Texas) shall consist of the union of one man and one woman. Second, the state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage. There is only one status identical to marriage; and that is marriage. This first provision is invalidated by the second. Marriage, no matter how defined, was illegal in Texas.

If Texans are seriously interested in defending marriage, instead of bashing gays, they may want to consider a proposition floating around in California. Ban divorce. That is how marriage is truly defended. Just ask Jesus.
